- A claim can be filed against an ATA Carnet
in a situation where an ATA Carnet is issued in another country
other than the U.S. and goods are imported into the U.S. and
not exported within one (1) year. An ATA Carnet CANNOT be extended
beyond the one year date.
- A claim can be filed against an
ATA Carnet in a situation where an ATA Carnet is issued in the
U.S. and the materials are exported but not returned to the United
States within the one (1) year period. Items 1 & 2 above
are identical in circumstance and simply reversed as to the originating
point of the merchandise. The point is simply the fact goods
must be exported from the originating country and returned to
the originating country within ONE (1) YEAR of the issuance date
of the ATA Carnet. The U.S. Council for International Business
will set an expiration date at the time your ATA Carnet is issued.
However, a foreign Customs authority has the right to restrict
any shipment and require that the goods leave prior to the date
granted by the U.S. Council for International Business. If a
foreign Customs authority provides any such limit, the information
will be noted on the importation counterfoil at the time of entry
into the country.
- A claim can be filed against an ATA Carnet
if the document is not properly validated by Customs at all points
of export or import along the way. At the points goods are exported
from the United States under an ATA Carnet, proper notification
must be given to U.S. Customs. U.S. Customs has the option of
performing an examination of the merchandise, if desired. They
must certify the exportation process by validating the appropriate
portion of the ATA Carnet. The same holds true with the return
of the merchandise to the United States within the one (1) year
period. The ATA Carnet must again be presented to U.S. Customs.
Once again they have the option of performing an examination
of the merchandise. U.S. Customs must validate the appropriate
portion of the ATA Carnet to complete the process. Segments of
the ATA Carnet must be validated by Customs in the foreign country
or countries and it applies to both the importing and exporting
processes. The validations provide a record of movement of the
merchandise and the ATA Carnet simply contains the history as
would be the case for the passports of individuals.
- A claim can be filed against an ATA Carnet
in a circumstance where there has been an improper or inadequate
description of merchandise on the ATA Carnet General List. The
General List must contain full descriptions of merchandise /
materials to allow full identity of the item or items covered
by the ATA Carnet.
